Welcome to Createful! Livecreateful.com, CreativeHealthTherapy.com (“Sites”) and the Createful app (“App”) provide wellness services. App and Sites offer health information designed for educational purposes only. To make these Terms easier to read, Sites, our services offered and App are collectively called the “Services.” Please read these Terms of Service (the “Terms”) carefully because they govern your use of our Services.
Introduction:
The following document outlines the informed consent for remote therapy, including a waiver of certain provisions of the Health Insurance Portability and Accountability Act (HIPAA) related to remote therapy. This document aims to provide you with an understanding of what remote therapy is, how it works, and what you can expect. Please read the information carefully and feel free to ask any questions or clarify any concerns you may have.
Purpose:
Remote therapy is a form of mental health treatment that utilizes electronic communication technologies to facilitate therapy sessions between the therapist and the client. The purpose of remote therapy is to provide you with a safe and effective means of accessing therapy from the comfort and privacy of your own space.
Eligibility:
To be eligible for remote therapy, you must be located in a state where our services are authorized to be provided. Please note that we are not authorized to provide services in all states. You must also be at least 18 years of age or have parental consent.
Benefits:
The benefits of remote therapy include convenience, flexibility, and accessibility. You can participate in therapy sessions from any location that has an internet connection. This allows you to schedule sessions at a time and place that works best for you. Remote therapy also eliminates the need for travel, which can be time-consuming and costly.
Risks:
There are some risks associated with remote therapy that you should be aware of. These risks include, but are not limited to, technical difficulties such as internet outages, connectivity issues, and software failures. These technical issues may interrupt or disrupt therapy sessions, which may negatively impact the therapeutic process. In addition, the use of electronic communication technologies may result in a breach of confidentiality, despite reasonable efforts to protect your privacy.
HIPAA:
To participate in remote therapy, you will need to sign a waiver of certain provisions of HIPAA related to remote therapy. This waiver allows for the use of electronic communication technologies that may not meet the same standards of confidentiality and security as traditional face-to-face therapy sessions.
Confidentiality:
Your privacy and confidentiality are of utmost importance to us. All information shared during remote therapy sessions will be kept confidential to the extent required by law. However, please be aware that there are certain limitations to confidentiality when utilizing electronic communication technologies. For example, it is possible that others may be able to overhear your session if you are not in a private location.
Limits of remote therapy:
Remote therapy has its limits and may not be appropriate for everyone. In some cases, in-person therapy may be necessary to address certain mental health issues. Your therapist will assess your individual needs and determine whether remote therapy is a suitable treatment option for you. While our practitioners are licensed, by engaging in remote therapeutic services, you are waiving any jurisdictional limitations of state licenses.
Your Role:
As a client, you have an important role in the therapeutic process. It is important that you participate actively in the therapy sessions and provide honest and open feedback to your therapist. You should also inform your therapist of any technical issues or interruptions that may affect your ability to participate in therapy sessions.
Nature of therapeutic experiences:
Therapeutic experiences may involve physical, emotional, and psychological challenges. While every effort is made to ensure the safety of clients, there are inherent risks associated with engaging in these experiences. By participating in a therapeutic experience, you acknowledge and assume these risks.
Limits of therapeutic experiences:
Therapeutic experiences are not appropriate for everyone and may not be suitable for individuals with certain physical or mental health conditions. It is your responsibility to inform your therapist of any physical or mental health issues you may have that could impact your ability to participate safely in therapeutic experiences. For any emergencies, please call 911 immediately.
Waiver and release of liability:
By signing below, you acknowledge that you have read and understood the information outlined in this disclaimer. You understand and accept the risks associated with engaging in therapeutic experiences and agree to release Creative Health Inc., its owners, employees, and contractors from any liability for any injury, harm, or damages that may occur as a result of your participation in therapeutic experiences.
Fees:
Our fees for remote therapy are based on the length of the session and the qualifications of the therapist. Payment is due at the time of service and can be made via credit card or other approved payment methods. We reserve the right to change our fees at any time but will provide notice of any fee changes in advance. You acknowledge the financial obligation to pay out of pocket for these services. Insurance super-bills will not be provided unless specifically discussed and agreed-to in writing by your Provider. One-on-one 10-minute mini-intake sessions are free; thereafter, therapy will be billed under the specific schedule of fees and services outlined by your Practioner.
Cancellation and Rescheduling:
If you need to cancel or reschedule a therapy session, please provide at least 24 hours' notice. If you do not provide notice or fail to show up for a session, you will be charged the full fee for that session.
Termination:
We reserve the right to terminate therapy services at any time if we determine that therapy is no longer appropriate for you or if you violate any of our policies.
Consent:
By signing below, you acknowledge that you have read and understood the information outlined in this document. You consent to participate in remote therapy and waive certain provisions of HIPAA related to remote therapy. You understand the risks and benefits of remote therapy, as well as the limits of confidentiality and security associated with the use of electronic communication technologies. You also understand that you may withdraw your consent at any time by contacting your therapist.
